Terms & Conditions – Coaching Services

ACS PowerData, operated by ACS FORMATION (SIREN 888682606), offers individual coaching sessions dedicated to Microsoft Power Platform tools (Power BI, Power Apps, Power Automate, Excel). Sessions are conducted remotely via Microsoft Teams or Zoom.

Available coaching packages:

Coaching sessions are booked online via the Calendly scheduling platform accessible from the ACS PowerData website. By booking a session, the client acknowledges having read and accepted these Terms & Conditions.

A confirmation email is sent automatically upon booking, including the date, time, video conferencing link, and a summary of the chosen package. The booking becomes firm and final once the payment has been received (except for the free Discovery session).

Prices are listed in euros and include all taxes. VAT is not applicable pursuant to Article 293 B of the French General Tax Code (franchise en base de TVA).

Payment is processed securely via Stripe. Accepted payment methods include credit/debit cards (Visa, Mastercard, American Express) and PayPal. Payment is required in full at the time of booking.

An invoice is automatically generated and sent by email after payment.

The following cancellation policy applies to all paid coaching sessions:

• More than 48 hours before the session: Full refund or free rescheduling.
• Between 24 and 48 hours before: 50% refund or rescheduling subject to availability.
• Less than 24 hours before: No refund. The session is considered delivered.

Cancellation and rescheduling requests must be made via the link provided in the confirmation email or by contacting contact@acs-powerdata.com.

Sessions are conducted via Microsoft Teams or Zoom. The video conferencing link is provided in the confirmation email.

Technical requirements:

• Stable internet connection
• Computer with webcam and microphone
• Relevant software installed (Power BI Desktop, Excel, etc.) as indicated during booking

Punctuality is required. A tolerance of 15 minutes is granted. Beyond this delay, the session is considered completed and no refund will be issued. The coach reserves the right to end the session at the originally scheduled time.

The coaching service constitutes an obligation of means, not an obligation of result. ACS PowerData commits to providing the best possible guidance based on the client's stated objectives and skill level.

After each session, a recap email is sent to the client summarizing the key points covered, recommendations, and any relevant resources or files shared during the session.

A 7-day post-session email support is included for brief follow-up questions related to topics covered during the session. This support does not include new development work or extensive consulting.

All materials, documents, templates, and resources provided during coaching sessions remain the intellectual property of ACS PowerData unless explicitly stated otherwise. The client is granted a personal, non-transferable, non-exclusive license to use these materials for their own professional purposes.

Any reproduction, distribution, or commercial use of the provided materials without prior written consent from ACS PowerData is strictly prohibited.

ACS PowerData is bound by an obligation of means. In no event shall ACS PowerData be held liable for indirect damages, including but not limited to loss of profit, loss of data, or business interruption resulting from the use or inability to use the coaching services.

The total liability of ACS PowerData is limited to the amount paid by the client for the session in question.

ACS PowerData shall not be held liable in cases of force majeure, including but not limited to: internet outages, platform failures (Teams, Zoom, Stripe), natural disasters, pandemics, or government actions preventing the delivery of services.

ACS PowerData is committed to protecting the confidentiality of all information shared during coaching sessions. No client data, business information, or session content will be disclosed to third parties without the client's prior written consent.

In accordance with the General Data Protection Regulation (GDPR), personal data collected (name, email, booking details) is used exclusively for the purpose of delivering coaching services and sending invoices. Data is retained for a maximum period of 3 years from the last interaction.

You may exercise your rights of access, rectification, deletion, and portability by contacting contact@acs-powerdata.com.

Any complaint must be submitted in writing within 7 calendar days following the coaching session by email to contact@acs-powerdata.com. ACS PowerData commits to responding within 15 business days.

In the event of a dispute that cannot be resolved amicably, the parties agree to seek mediation before initiating any legal proceedings. The competent courts shall be those of the registered office of ACS PowerData, subject to French law.

These Terms & Conditions are governed by French law.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

ACS PowerData reserves the right to modify these Terms & Conditions at any time. Any changes will be published on this page with an updated date. Clients are encouraged to review these Terms regularly. The applicable Terms are those in effect at the time of booking.

The fact that ACS PowerData does not exercise any right or provision of these Terms at any time shall not constitute a waiver of such right or provision.
